The firm

Nardello was established in London in 2003 and has since established a strong international presence with offices in New York, Washington, DC, Los Angeles, Hong Kong, Tokyo, Milan and Dubai.

At the forefront of the practice is its eponymous chairman and CEO, Daniel Nardello. He’s a former federal prosecutor in the Southern District of New York, where, as a member of the office’s Securities and Commodities Fraud Task Force, he tried over 20 jury trials.

Other names to know stateside include DC-based chief operating officer Sabina Menschel and Tara MacMillan in New York. Menschel has over 20 years of experience in government and private sector roles. She’s a former special adviser in the FBI’s directorate of intelligence, where she helped implement changes in response to recommendations made by the 9/11 Commission. MacMillan leads the regional Americas practice and manages international anti-corruption compliance for several multinationals. Warren Feldman, the firm’s chief legal officer, is currently spending time in London as interim EMEA regional head.

Eastern Europe specialist Alan Kennedy in London returned to the consultancy as a managing director in April after a stint at law firm Schillings where he was a senior associate. Kennedy’s experience on global investigations has included anti-Mafia investigations in Italy, assisting high-net-worth individuals from the former Soviet Union in litigation in New York, London and Moscow, as well as foreign bribery probes in Russia, Azerbaijan, Armenia, Kazakhstan and Saudi Arabia.

Ben Rowse, the firm’s Tokyo-based Asia-Pacific head, is a veteran investigations practitioner in the region. As is Amie Chang, who manages the Los Angeles office, which opened its doors in September, giving Nardello a valuable presence on the US west coast. Former US diplomat Chang originally joined the firm in 2016 as head of its Hong Kong office to oversee Nardello’s investigations in China as well as in the wider region.

In February, Nardello announced it had hired trial and investigations lawyer Howard Master and former US Drug Enforcement Administration investigator Chris Urben as managing directors in its New York and Washington, DC offices, respectively.

Recent Events

Most of the consultancy’s recent work for clients is strictly confidential but Nardello says it has included assisting corporations in defending against activist funds, conducting asset tracing investigations, responding to cyber threats and providing risk advisory services. 

Some cases the firm has worked on have reached the public domain. In November, the new CEO of collapsed cryptocurrency exchange FTX said he had hired Nardello, alongside investigations lawyers at Sullivan & Cromwell, to conduct a probe into the company’s dramatic recent bankruptcy. The Bahamas-based business filed for bankruptcy shortly after rumours of financial improprieties resulted in FTX customers withdrawing their funds en-masse.

Track Record

Significant matters on Dan Nardello’s résumé include serving as the independent investigator, appointed by the government of Abu Dhabi, of allegations of abusive labour practices in the construction of New York University’s Abu Dhabi campus. He was also named as the independent investigator resolving issues arising from a settlement agreement between the State of New York and leading tobacco companies.

In 2010, the firm was retained by a US law firm to assist in the criminal defence of an AIG employee, David Pinkerton, who was charged with alleged FCPA violations in Azerbaijan. Nardello investigators unearthed information about the key witnesses against Pinkerton that undermined the case against him and led to the dismissal of the charges.

The same year, Clifford Chance instructed Nardello on behalf of Brazilian miner Vale to conduct on the ground due diligence ahead of a $500 million joint venture in Guinea with Beny Steinmetz Group Resources (BSGR). GIR reported in February that the lawyer overseeing the project described Nardello’s work as “substantial” when quizzed about it during a civil trial in London in an ultimately unsuccessful lawsuit that Vale brought against BSGR’s founder after the joint venture collapsed amid bribery allegations.
