Risks and Opportunities Arising from DOJ’s New “Compliance Counsel”
In light of existing guidance, the main benefits from this new appointment – if and when it is finalized – seems most likely to be greater standardization of DOJ’s expectations for compliance programs and hopefully a further indication of DOJ’s seriousness in considering such programs when making charging decisions, even absent a formal compliance defense.
