Costa Rican Utility Seeking Bribery Restitution Has No Standing, U.S. Argues on Appeal

In a hearing today, the Justice Department argued that even if the Costa Rican utility could be declared a “victim,’’ it still would not qualify for procedural standing in the courts because there is no judgment from which to appeal. While several Alcatel subsidiaries pleaded guilty to FCPA violations in Costa Rica and elsewhere, the parent company paid the global settlement under a deferred prosecution agreement.
