Pre-trial victory for Hoskins as judge limits defendant’s FCPA liability

The US government must show that former Alstom executive Lawrence Hoskins, a non-US resident foreign national, qualifies as an “agent of a domestic concern” under the FCPA, before he can be successfully prosecuted for conspiring to bribe Indonesian officials, a judge has ruled.
