BHP Billiton: remove facilitation payment defence from Australian law
Mining company BHP Billiton has called on the Australian government to outlaw facilitation payments and introduce deferred and non-prosecution agreements. The company, which agreed to pay US$25 million in May to settle FCPA charges brought by the US Securities and Exchange Commission, made the recommendations as part of a general inquiry into foreign bribery being carried out by the Australian Senate.
