9.40: Session one: Targeting the ‘gatekeepers: Emerging challenges for financial industry legal and compliance professionals
 
From FIFA to Petrobras, money-laundering prosecutors are increasingly piggy-backing on marquee criminal investigations to examine whether financial institutions are failing to flag underlying crimes committed by their customers. This trend – combined with the Yates Memo’s announced focus on individual prosecutions as well as proposed rules in New York state to require chief compliance officers to certify their bank’s controls – has put bank legal and compliance personnel in the cross-hairs of law enforcement.  As they weigh how aggressively to investigate alleged wrongdoing in their organizations or which matters to elevate, the so-called gatekeepers are facing significant questions about what it means to work in compliance at a financial institution today. 
 
Leading names will hold a roundtable style debate, with the audience joining in. Questions expected to be discussed include:
 
  • Under pressure to pursue individual misconduct, will prosecutors begin to see compliance personnel as easy pickings?
  • If so, will corporate compliance find itself stronger or weaker as a result?
  • What actions (or non-actions) are now particularly risky for compliance personnel in the new era of individual accountability?

This unique session allows for a free-flowing discussion facilitated by an expert moderator. Attendees will supply written questions in advance. Those audience members whose questions are selected for discussion will stand, introduce themselves, and pose their queries, at which time the panel will be thrown open to discussion. Audience participation encouraged. The GIR Live Q&A therefore offers a one-of-a-kind opportunity to benchmark one’s own practice against that of others, and to get opinions on those questions that can’t be researched in any other way.
